I couldn't agree with you more, Judge Silvernail heard the case ( a domestic violence injunction petition) requested by then wife. he completely believed her statements, despite factual evidence that countered every single point. In it she stated this woman friend of hers was actuallyher "mother" when in fact she was just living with her (and our 3 children).
Secondly, the unbelievable part, she alleges "sexual rape" as her chief complaint, states it went on for 7 years...the ENTIRE time of our marriage. Yet, he asks ..."and you had 3 children with this man?" to which she says "yes".
He grants her petition for injunction against domestic violence to "err on the side of caution" he throws me out on the street from my home which is paid for, fully stocked and MY HOME! Later he finds out she's not on the lease and orders her out.
As for visitation, she refuses his "regularly scheduled visitation" she reads it to mean whenever the h**l SHE wants me to see them. So I file a motion of contempt on it, another judge heard my complaint, he told her she had 48 hours to arrange for visitation or he'd jail her for (60) days.
It happened 3 more times and each time HE heard the case, basically ignored his own ruling and the law and dismissed my complaint finding no contempt, despite not being allowed to my court ordered visitation!
Then she's filed a motion to remove my visitation alltogether, thankfully Silvernail denied it, but later she comes up with more allegations of abuse against my own children, pretty much putting me in fear I'd be arrested again for something I didn't do!
I'm waiting for January 2009 so I can file for a new hearing because he will not be on the case anymore, and if he is I'll move to get him recused because of his open MALE biased opinions.
