My INNOCENt brother Nolan Klein, had been in prison for over 21 years for a crime he did not commit. In May 2009 Washoe County Judge Brent Adams order the District Attorney D**k Gammick to turn over the DNA test results and the entire file in Nolan's case. On June 10, 2009 the entire file that was ordered to be turned over. In the file prosecutor Ron Rachow made personal notes that he was not turning over any of the exculpatory or Materiality evidence in this case. The evidence withheld showed that they knew that another person was responsible for the crime for which my brother Nolan Klein was convicted of.
As Nolan attorney's were working on his Motions for bail and Motions for New Trial based on newly discovered evidence that showed that Ron Rachow withheld the evidence that cleared him of the crime, Nolan had passed away. The Motions could not be filed because they are now moot. However, a Petition for Exoneration is now in the works. I'd like to know if anyone has ever done a Petition for Exoneration in the 9th circuit. If so, what is the case?
Now our Nevada Attorney General, Katherine Cortez Masto is trying to get all of Nolan's cases that are still pending in our state and federal courts. Nolan has two lawsuits pending, one was going to trial. He has the 9th circuit court of appeals writ and what was found in the file supports his claims in this court.
